§1. General Provisions
1. These Terms of Service determine the rules for using the website available at https://urbshop.com.
2. The Exhibition is operated by Fundacja Urbaniak.Com with its registered office in Warsaw, Poland (ul. Żelazna 67/75, 00-871 Warszawa), entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000213808, NIP 7251891649, REGON 473299900 (hereinafter: “Foundation”).
3. The Terms of Service constitute the regulations for the provision of electronic services within the meaning of Article 8 of the Act of July 18, 2002, on the provision of electronic services.
4. Contact with the Foundation regarding matters related to the Exhibition is possible via the email address: fundacja@urbaniak.com.
5. Using the Exhibition constitutes acceptance of these Terms of Service.
§2. Definitions
a) Foundation — Fundacja Urbaniak.Com, as defined in §1 sec. 2.
b) Exhibition / Website — the website operated by the Foundation, presenting an offer of goods in the form of a catalog (descriptions, photographs, informational prices), which does not allow for independent placement of an order or conclusion of a sales agreement.
c) Seller — Paweł Żuczkiewicz, conducting business activity, independently selling the goods presented at the Exhibition through his own separate website (Seller’s Store). Exact data identifying the Seller: Paweł Żuczkiewicz S7, ul. Stoczniowców 23, 81-457 Gdynia, NIP 5861934103, REGON 193083341.
d) Seller’s Store — the website operated independently and on his own account by the Seller, functioning under a separate domain klubplytowy.pl, through which it is possible to place an order and conclude a sales agreement for the goods.
e) User — any person using the Exhibition.
§3. Nature and Scope of Services Provided by the Foundation
1. The Exhibition is strictly of an informational and presentational nature. Through it, the Foundation provides a catalog of goods (name, description, photograph, informational price) available in the Seller’s offer.
2. The Foundation does not sell the goods presented at the Exhibition, does not accept orders, and does not handle the process of purchasing, payment, delivery, returns, or complaints regarding the goods. The Foundation is not a party to any sales agreement concluded between the User and the Seller.
3. The sole entity conducting the sale of goods presented at the Exhibition and the party to the sales agreements concluded with Users is the Seller.
§4. Technical Requirements
1. Using the Exhibition requires a device with Internet access and a current web browser supporting HTML5, CSS3, and JavaScript standards, as well as — to the extent indicated in the Privacy Policy — acceptance of cookies necessary for the proper functioning of the Exhibition.
2. The Foundation does not guarantee the uninterrupted availability of the Exhibition and makes every effort to ensure that technical breaks in its operation are as short as possible and, when possible, announced in advance.
§5. Redirection to the Seller’s Store
1. Next to each product presented at the Exhibition, there is a “Buy in the Shop” button, accompanied by information that the sale of the given product is conducted by the Seller.
2. Clicking the button redirects the User to the Seller’s Store website, operating under a domain separate from the Exhibition and run independently by the Seller.
3. From the moment of redirection, the User’s use of the further service is subject exclusively to the terms of service, return policy, and privacy policy applicable in the Seller’s Store, not these Terms of Service.
4. The Foundation has no influence on the content, availability, or legal compliance of the Seller’s Store and is not responsible for its functioning or for the course and effects of transactions concluded through it, including order fulfillment, quality of goods, delivery time, or the method of handling complaints.
§6. Prices Presented at the Exhibition
1. The prices of goods presented at the Exhibition are of an informational nature.
2. The price binding for the User is the price indicated in the Seller’s Store at the time of placing the order. The Foundation makes every effort to ensure that the prices presented at the Exhibition correspond to the prices applicable in the Seller’s Store, but cannot guarantee their current compliance each time and is not responsible for any resulting discrepancies.
§7. Intellectual Property
1. The domain, name, trademarks, logo, graphic layout, photographs, and other elements of the Exhibition are the property of the Foundation or are used by the Foundation on the basis of appropriate rights, and are subject to protection under legal provisions, in particular the Act on Copyright and Related Rights and the Industrial Property Law.
2. Using the elements indicated in sec. 1, including their copying, reproduction, or use for commercial purposes, requires the prior written consent of the Foundation, except for use within the scope permitted by law.
§8. Liability of the Foundation
1. The Foundation makes every effort to ensure that the information presented at the Exhibition (descriptions, photographs, informational prices) is reliable and up-to-date.
2. The Foundation is not responsible for:
a) the course, execution, and effects of sales agreements concluded between the User and the Seller through the Seller’s Store,
b) the content, availability, security, and legal compliance of the Seller’s Store,
c) damages resulting from the use of the Seller’s Store.
3. The provisions of sec. 2 do not limit the liability of the Foundation for damage caused to the User intentionally or as a result of gross negligence (Article 473 § 2 of the Civil Code) or liability resulting from absolutely binding provisions of law.
§9. Personal Data Protection
The rules for processing Users’ personal data in connection with the use of the Exhibition are determined by the Privacy Policy, available at the Exhibition, constituting an integral part of using the Exhibition.
§10. Complaints Regarding the Functioning of the Exhibition
1. Complaints regarding the functioning of the Exhibition itself (e.g., technical errors, website unavailability) may be submitted to the email address indicated in §1 sec. 4.
2. The Foundation reviews the complaint and provides a response within 14 days from the date of its receipt.
3. This section does not apply to complaints related to goods purchased in the Seller’s Store — such complaints should be directed directly to the Seller, in accordance with the rules set out in the Seller’s Store terms of service.
§11. Final Provisions
1. The Foundation reserves the right to amend the Terms of Service for valid reasons, in particular in connection with a change in legal provisions or a change in the scope of the Exhibition’s functionality. The Foundation will inform about the amendment to the Terms of Service by posting the updated content on the Exhibition with appropriate advance notice.
2. Polish law applies to these Terms of Service and to the use of the Exhibition.
3. In matters not covered by the Terms of Service, generally applicable provisions of Polish law apply, in particular the Civil Code and the Act on the provision of electronic services.
4. The Terms of Service enter into force on the date indicated by the Foundation upon their publication at the Exhibition (September 14, 2026).
